1. GENERAL PROVISIONS
1.1. For the purposes of these Safety Rules:
Safety Rules – these Safety Rules for the Use of the Territory and Equipment In and Around Water, which establish safety requirements, restrictions on use, allocation of risks, limitations of liability, and the obligations of Persons in relation to their presence within the Territory, as well as the use of the infrastructure and Equipment associated with the Territory.
Person – any natural person who is present within the Territory or uses the infrastructure associated with the Territory, the Equipment, or the services of SEOVILLAGE.
Lessee – a Person who receives the Equipment for use or under a lease, irrespective of whether a written agreement has been concluded between the parties.
Minor – a Person who has not attained eighteen (18) years of age.
Equipment – any boats, paddles, life jackets, fishing rods, stand-up paddleboards (SUP boards), pontoons, or any other equipment owned, leased, managed, or made available for use by SEOVILLAGE.
Territory – the lake, swimming areas, piers, docks, access points to the water, shoreline areas, places for storing or using the Equipment, and any other infrastructure or area associated with being in and around the water located in Ezermaļi, Ķeipene Parish, Ogre Municipality, Latvia, which is owned, possessed, managed, or used by SEOVILLAGE.

1.2. These Safety Rules establish a binding procedure, safety requirements, restrictions on use, allocation of risks, limitations of liability, and the obligations of Persons in relation to their presence within the Territory (including in and around the water), as well as the use of water-related infrastructure and Equipment within the Territory owned, possessed, managed, or used by SEOVILLAGE.
1.3. These Safety Rules form an integral part of all agreements, arrangements, reservations, Equipment rental relationships, handover and acceptance certificates, internal rules, and any other legal relationships between SEOVILLAGE and any Person who is present within the Territory, uses the services or Equipment of SEOVILLAGE, or in any way participates in activities within the Territory (including in and around the water).
1.4. Every Person, by entering or remaining within the Territory, using or attempting to use the Equipment or infrastructure, or participating in any activities in and around the water, confirms that they have fully familiarised themselves with these Safety Rules, understand the risks associated with being in and around the water, are aware of the possible risks to their health, life, and property, assume full personal responsibility for their actions, safety, and health condition, and agree to the limitations of liability provided for in these Safety Rules.
1.5. The Person acknowledges and agrees that the Territory and the infrastructure associated with it are natural or semi-natural environmental features involving increased hazards, where complete control or the elimination of all safety risks is not possible. The Person acknowledges that the Territory may contain, including but not limited to, slippery or unstable surfaces, uneven or changing ground, holes, aquatic vegetation, sharp objects, variable or unpredictable water depth, currents, waves, limited visibility, the effects of weather conditions, strong winds, rain, fog, lightning, cold water, the risk of hypothermia, the risk of drowning, the risk of collisions, mechanical damage, as well as hazards caused by wild animals, insects, or other natural factors.
1.6. SEOVILLAGE does not provide rescue services, does not carry out continuous supervision of the Territory or its infrastructure, and does not guarantee the continuous presence of lifeguards, medical personnel, security personnel, or other safety services within the Territory. Any assistance that may be provided by SEOVILLAGE personnel in an emergency situation shall be regarded solely as assistance provided in good faith and shall not create any obligation for SEOVILLAGE to provide rescue or medical assistance functions.
1.7. The Equipment, as well as all water bodies and the infrastructure associated with them, shall be used solely at the Person’s own risk and responsibility. To the fullest extent permitted by applicable laws and regulations, SEOVILLAGE shall not be liable for any accidents, injuries, damage to health, drowning, death, damage to property, loss of property, or any direct, indirect, or consequential losses incurred by the Person or third parties while present within the Territory (including in and around the water) or while using the Equipment, except where such liability is expressly provided for by applicable laws and regulations and cannot be limited or excluded.
2. GENERAL SAFETY OBLIGATIONS, RESTRICTIONS ON USE, AND PROHIBITIONS
2.1. Every Person who is present within the Territory (including in and around the water) or uses any SEOVILLAGE Equipment or infrastructure is obliged to act prudently, carefully, and in accordance with generally accepted safety principles, to comply with all SEOVILLAGE rules, the instructions of SEOVILLAGE personnel, and applicable laws and regulations, as well as to independently assess their own health condition, physical fitness, swimming ability, experience, weather conditions, visibility conditions, and other factors that may affect the safety of the Person or third parties.
2.2. Every Person is fully responsible for their own safety, health, life, conduct, and decisions while present within the Territory (including in and around the water), including their ability to swim, stay afloat, safely use the Equipment, navigate on the water, and respond appropriately in emergency or hazardous situations. SEOVILLAGE does not assess the physical abilities, health condition, swimming ability, or competence of Persons and shall not be liable for the consequences arising from a Person’s insufficient skills, health condition, or imprudent conduct.
2.3. Persons, who are unable to swim or who have insufficient swimming skills may be present on the water only while wearing a properly secured life jacket and entirely at the Person’s own risk and responsibility.
2.4. Minors are prohibited from being present within the Territory (including in and around the water) without the direct, continuous, and actual supervision of an Adult Person. The Adult Person accompanying the Minor assumes full responsibility for the Minor’s safety, health, life, conduct, and for any consequences arising from the Minor’s actions or omissions.
2.5. Being present within the Territory (including in and around the water) while under the influence of alcohol, narcotic drugs, psychotropic substances, or other intoxicating substances is strictly prohibited. SEOVILLAGE has the right, at its own discretion, to refuse to issue Equipment, immediately terminate the Equipment rental, deny access to the Territory, or require a Person to immediately leave the Territory if there are suspicions that the Person is under the influence of intoxicating substances or if the Person’s conduct poses a safety risk to themselves or to other Persons.
2.6. Without the prior written permission of SEOVILLAGE, being present within the Territory (including in and around the water) during the hours of darkness or in conditions of insufficient visibility is prohibited, including after sunset, during fog, heavy rain, thunderstorms, or in any other conditions where visibility or safety is limited.
2.7. Persons are prohibited from using the Equipment or being on the water during thunderstorms, strong winds, hazardous weather conditions, or any other unsafe conditions, as well as from exceeding the permitted load capacity of the Equipment, using damaged Equipment, or using the Equipment for purposes other than its intended use.
2.8. For safety reasons, the following are prohibited:
- jumping or diving into the water from the Equipment or infrastructure;
- intentionally rocking, capsizing, damaging, or otherwise using the Equipment in an unsafe manner;
- organizing dangerous amusements, stunts, or other hazardous activities on the water;
- being present or swimming outside the permitted areas;
- transferring the Equipment to third parties without the permission of SEOVILLAGE.
2.9. SEOVILLAGE has the right, at any time and at its own discretion, to restrict or prohibit access to the Territory or the Equipment, terminate the Equipment rental, refuse to provide services, or require a Person to leave the Territory immediately if, in the opinion of SEOVILLAGE, the Person’s conduct, health condition, influence of intoxicating substances, weather conditions, safety considerations, requirements of applicable laws and regulations, or other circumstances pose or may pose a threat to Persons, property, the Equipment, or the environment.
2.10. In emergency situations, hazardous weather conditions, technical failures, rescue operations, or other safety risks, every Person is obliged to immediately comply with the instructions of SEOVILLAGE or the competent authorities, cease all activities, return to shore, or leave the Territory if requested to do so for safety reasons.
3. USE OF LIFE JACKETS AND SAFETY EQUIPMENT
3.1. The use of a life jacket is mandatory for all Persons who use the Equipment or are present on the water, as well as for Minors, Persons with insufficient swimming skills, and in other cases at the discretion of SEOVILLAGE or in accordance with the instructions of SEOVILLAGE personnel.
3.2. Every Person is fully responsible for the proper, safe, and continuous use of a life jacket and other safety equipment, including the selection of an appropriate size, proper fastening, use, and the overall suitability thereof for the particular Person and the particular activity. Before using the Equipment, the Person shall independently verify the visual condition of the life jacket and other safety equipment, as well as the instructions for their use.
3.3. SEOVILLAGE does not assess the physical parameters, health condition, swimming ability, or individual suitability of Persons and shall not be liable for the consequences arising from the improper, inappropriate, or unsafe use of a life jacket or other safety equipment.
3.4. The Person acknowledges and agrees that a life jacket and safety equipment do not guarantee complete protection against drowning, injuries, damage to health, or death and do not completely eliminate the risks associated with being present within the Territory (including in and around the water).
3.5. SEOVILLAGE has the right to prohibit the use of the Equipment or require a Person to immediately cease being on the water if the Person does not use a life jacket or other mandatory safety equipment in accordance with these Safety Rules or the instructions of SEOVILLAGE personnel.
4. SAFETY AND SUPERVISION OF MINORS
4.1. Minors are permitted to be present within the Territory (including in and around the water) only under the direct, continuous, and actual supervision of an Adult Person.
4.2. Parents, guardians, or other Adult Persons who accompany a Minor or are responsible for the Minor’s presence within the Territory assume full, exclusive, and continuous responsibility for the Minor’s safety, health, life, conduct, actions, and omissions, as well as for any consequences arising from insufficient supervision or failure to comply with these Safety Rules.
4.3. SEOVILLAGE does not supervise Minors, does not control their movement within the Territory, and assumes no obligation to ensure the safety, supervision, rescue, or care of Minors.
4.4. Parents, guardians, or other Adult Persons are fully responsible for any losses, damage, or harm caused by a Minor to SEOVILLAGE, the Equipment, third parties, or their property.
4.5. SEOVILLAGE has the right, at any time, to require a Minor or the Persons accompanying the Minor to immediately cease being present within the Territory (including in and around the water) if, in the opinion of SEOVILLAGE, there is a threat to the safety of the Minor, other Persons, the Equipment, or the environment.
5. USE OF THE EQUIPMENT AND THE RESPONSIBILITY OF THE LESSEE
5.1. Only an Adult Person who has fully familiarized themselves with these Safety Rules, understands the risks associated with the use of the Equipment, and is able to use the Equipment safely and responsibly in accordance with its intended purpose is entitled to use the Equipment.
5.2. From the moment the Equipment is handed over, the Lessee assumes full financial, civil, and personal responsibility for the use, safekeeping, and security of the Equipment, as well as for the Persons to whom the Equipment is handed over or made available. The Lessee is fully responsible for any losses, damage, injuries, accidents, third-party claims, administrative penalties, the costs of rescue operations, and any other consequences arising from the use of the Equipment.
5.3. The Lessee is prohibited from transferring the Equipment for the independent use of another Person without the prior written permission of SEOVILLAGE. Such a violation shall be considered a material violation of these Safety Rules.
5.4. Before using the Equipment, the Lessee is obliged to verify the visual condition of the Equipment, its completeness, and the absence of any obvious damage. Upon receiving the Equipment, the Lessee confirms that the Equipment has been received in a condition suitable for use.
5.5. It is prohibited to use the Equipment by exceeding its permitted load capacity, using it contrary to its intended purpose, or using it in any other manner that may pose a threat to Persons, the Equipment, other property, or the environment.
5.6. The Lessee is fully and independently responsible for ensuring that all fishing, angling, or activities on the water comply with applicable laws and regulations, including the possession of any required permits, licences, or other documents.
5.7. SEOVILLAGE provides no guarantees regarding the availability of fish, water conditions, the continuous availability of the Equipment, or the suitability of the Equipment for any particular purpose.
5.8. To the fullest extent permitted by applicable laws and regulations, SEOVILLAGE shall not be liable for the consequences arising from the use of the Equipment.
5.9. The Lessee is prohibited from using the Equipment for commercial purposes, the carriage of passengers, or the organization of public events without the prior permission of SEOVILLAGE.
6. USE OF THE INFRASTRUCTURE AND ACCESS POINTS
6.1. The water-related infrastructure located within the Territory, including piers, docks, stairs, swimming areas, access points to the water, shoreline areas, and other access structures, is intended only for careful and appropriate use in accordance with its functional purpose. The Person acknowledges and agrees that, due to weather conditions, moisture, temperature, natural conditions, or wear and tear, the infrastructure may become slippery, unstable, uneven, or otherwise more hazardous.
6.2. Every Person, while present within the Territory or using the infrastructure, is obliged to act with particular caution, comply with safety requirements, be aware of the surrounding conditions, and refrain from any conduct that may pose a threat to Persons, the Equipment, the infrastructure, or the environment.
6.3. For safety reasons, the following are prohibited:
- damaging, moving, or using the infrastructure without permission;
- jumping or diving into the water at unauthorized or unchecked locations;
- engaging in physically dangerous or aggressive conduct;
- posing a threat to or causing significant disturbance to other Persons.
6.4. The Person is fully responsible for any losses or damage caused to the infrastructure, the Equipment, the property of SEOVILLAGE, or third parties as a result of the Person’s conduct, negligence, or failure to comply with these Safety Rules.
7. HEALTH CONDITION, PHYSICAL FITNESS, AND MEDICAL RISKS
7.1. Every Person who is present within the Territory or uses the Equipment or infrastructure confirms that their health condition, physical fitness, coordination, swimming skills, and general physical and psychological condition are suitable for safely being present within the Territory (including in and around the water) and for using the Equipment.
7.2. The Person confirms that they have no known health disorders, medical limitations, or other physical or psychological conditions that may pose an increased risk to the safety of the Person or third parties, including epilepsy, disorders of consciousness, cardiovascular diseases, respiratory disorders, coordination disorders, panic attacks, or other health conditions that may affect the Person’s ability to be safely present within the Territory (including in and around the water), use the Equipment, or respond appropriately in emergency situations.
7.3. The Person is fully responsible for assessing their own health condition before commencing any activities and undertakes to immediately cease being on the water, using the Equipment, or engaging in any other activities if deterioration of health, dizziness, weakness, pain, difficulty breathing, panic, or other symptoms arise that may pose a threat to the safety of the Person or third parties.
7.4. SEOVILLAGE does not carry out health examinations, medical assessments, or supervision of Persons and does not provide medical recommendations regarding a Person’s ability to use the Equipment or participate in activities within the Territory. Any instructions provided by SEOVILLAGE personnel shall not be regarded as medical advice or a professional medical assessment.
7.5. To the fullest extent permitted by applicable laws and regulations, SEOVILLAGE shall not be liable for deterioration of a Person’s health, injuries, hypothermia, loss of consciousness, panic attacks, drowning, death, or any other consequences arising from the Person’s health condition, physical fitness, individual characteristics, physical exertion, weather conditions, or other circumstances beyond the Person’s control.
8. LIMITATION OF LIABILITY, ASSUMPTION OF RISK, AND COMPENSATION FOR LOSSES
8.1. Every Person, while present within the Territory (including in and around the water) or using the Equipment, infrastructure, or services, fully acknowledges and assumes all risks associated with being present within the Territory and using the Equipment, including risks to health, life, property, and safety, irrespective of whether such risks are foreseeable or unforeseeable.
8.2. To the fullest extent permitted by applicable laws and regulations, SEOVILLAGE, its officers, employees, representatives, and cooperation partners shall not be liable for any direct, indirect, incidental, or consequential losses, injuries, damage to health, accidents, damage to property, or other consequences arising in connection with a Person’s presence within the Territory, use of the Equipment, the actions of third parties, natural conditions, or other circumstances beyond the reasonable control of SEOVILLAGE. In cases where applicable laws and regulations do not permit the complete exclusion or limitation of liability, the liability of SEOVILLAGE shall be limited to the extent permitted by applicable laws and regulations.
8.3. The Person confirms that they fully acknowledge the increased hazards associated with being present within the Territory (including in and around the water) and using the Equipment, and voluntarily assume all risks associated with such activities, including risks that may arise as a result of weather conditions, natural conditions, the actions of other Persons, technical failures, health condition, or unforeseen circumstances.
8.4. To the fullest extent permitted by applicable laws and regulations, the Person waives the right to bring claims against SEOVILLAGE in respect of losses or consequences arising from risks that the Person has knowingly assumed in accordance with these Safety Rules.
8.5. The Person is fully responsible for any losses, damage, or consequences arising as a result of their conduct, omission, negligence, failure to comply with these Safety Rules, or violation of applicable laws and regulations.
8.6. The Person undertakes to compensate SEOVILLAGE for all losses, costs, claims, fines, administrative payments, costs of legal proceedings, and legal assistance costs arising as a result of the Person’s conduct, omission, violation of applicable laws and regulations, or failure to comply with these Safety Rules.
8.7. SEOVILLAGE shall not be liable for personal belongings, valuables, or equipment left unattended within the Territory, irrespective of the reason for their loss, damage, or theft.
8.8. Any assistance, recommendations, instructions, or other information provided by SEOVILLAGE personnel to Persons in connection with being present within the Territory or using the Equipment shall be regarded solely as information or assistance provided in good faith and shall not create any obligation for SEOVILLAGE to undertake professional rescue, safety supervision, or medical assistance functions.
9. FORCE MAJEURE, WEATHER CONDITIONS, AND NATURAL RISKS
9.1. SEOVILLAGE shall not be liable for any restriction, interruption, delay, or impossibility of providing services, activities, Equipment rental, access to the Territory, or use of the infrastructure if caused by force majeure or other circumstances beyond the reasonable control of SEOVILLAGE, including, but not limited to, adverse weather conditions, storms, thunderstorms, lightning, strong winds, rain, fog, floods, fire, interruptions to electricity supply or communications, natural disasters, changes in water level, ice formation, pollution, epidemiological restrictions, decisions of state or municipal authorities, instructions of rescue services, threats to public safety, or any other extraordinary, unforeseeable, or circumstances beyond the control of SEOVILLAGE.
9.2. The Person acknowledges and agrees that weather conditions, visibility, water conditions, currents, wind, temperature, and other natural conditions may change rapidly and unpredictably, creating an increased risk to the Person’s health, life, property, safety, or the use of the Equipment. The Person is fully responsible for assessing weather conditions and the surrounding conditions before commencing any activities within the Territory or using the Equipment.
9.3. In the event of force majeure, adverse weather conditions, technical conditions, safety risks, or other circumstances beyond the control of SEOVILLAGE, SEOVILLAGE has the right, at any time, to temporarily restrict or suspend access to specific parts of the Territory, the infrastructure, or the Equipment.
9.4. To the fullest extent permitted by applicable laws and regulations, SEOVILLAGE shall not be liable for any losses, injuries, damage to health, damage to property, or other consequences arising as a result of natural conditions, weather conditions, or force majeure, including, but not limited to, falling trees or branches, lightning, strong winds, waves, changes in water level, slippery surfaces, ice, flooding, or other natural processes.
10. FINAL PROVISIONS
10.1. These Safety Rules are binding upon all Persons from the moment they enter or are present within the Territory, use or attempt to use the Equipment or infrastructure, or in any way participate in activities within the Territory (including in and around the water), irrespective of whether the Person has made a reservation, entered into a written agreement, or made payment for services.
10.2. By making a reservation, signing Equipment rental documents, using the Equipment, being present within the Territory, or in any other way using the infrastructure or services of SEOVILLAGE, the Person confirms that they have fully familiarized themselves with these Safety Rules, fully understand their contents and legal consequences, and undertake to comply with them in full.
10.3. SEOVILLAGE has the right, at any time, to unilaterally amend, supplement, or update these Safety Rules without prior notice. The current version of these Safety Rules shall be binding from the moment of its publication within the Territory, on the SEOVILLAGE website, or through other information channels designated by SEOVILLAGE.
10.4. If a Person does not fully or partially agree with these Safety Rules, they shall not be entitled to be present within the Territory, use the Equipment or infrastructure, or participate in activities within the Territory (including in and around the water).
10.5. Any disputes, disagreements, or claims arising out of or in connection with these Safety Rules shall first be settled through negotiations. If no agreement is reached, such disputes shall be heard by the courts of the Republic of Latvia in accordance with the laws and regulations of the Republic of Latvia.
10.6. If any part, clause, or provision of these Safety Rules is found to be invalid, unlawful, or unenforceable, this shall not affect the validity, lawfulness, or enforceability of the remaining provisions, and the remaining provisions shall remain in full force and effect.
10.7. These Safety Rules shall be interpreted in accordance with their purpose of ensuring the safety of Persons, reducing risks, and protecting the rights and legitimate interests of SEOVILLAGE to the extent permitted by applicable laws and regulations.
